TERMS & CONDITIONS OF
MEMBERSHIP
In this contract we detail exactly the service we will provide you
with, including a guaranteed minimum number of introductions – "our side
of the bargain". In return we expect our members to fulfil their
obligations as detailed in this contract - "your side of the bargain".
DRAWING DOWN THE MOON LTD is herein referred to as 'DDM'.
I confirm and accept that:
1. I have received, read and understood the following
documents: - - Current brochure - Meet Your Match document
- Blank profile
- ABIA Code of Practice
2. I have received, will read and will abide by 'Notes for Members' (version dated Nov 2006).
3. I am sound in mind and body and I am unattached and free to form a relationship.
4. DDM has been retained by me to provide fifteen months of active membership with the purpose of introducing me to potential partners with the aim of forming a long-term relationship. I am also entitled to have one year of time on hold when my membership can be temporarily suspended because I am in a relationship with someone or am too busy to meet people. It is my responsibility to inform DDM when I wish to be on hold.
5. DDM is not bound to accept any person for membership and may at its sole discretion withdraw membership from any member whose behaviour it considers to have become unacceptable. Any member who fails to attend a pre-arranged meeting with another member without good reason, who in any other way abuses the services of DDM or who is offensive to another member stands to have his or her membership withdrawn without notice and without entitlement to refund of fees already paid.
6. DDM consultants will send Introduction Letters or emails to members. These introductions arranged by DDM consultants are an essential part of my membership of DDM and not an optional extra. I agree to telephone and make every endeavour to talk with members for whom I have been chosen by DDM consultants with the object of meeting for at least a 15 minute drink. If I do not wish to be chosen by DDM consultants then it is my responsibility to inform DDM that I wish to be on hold
7. Refusal to follow-up on introductions shall be deemed a tacit election to go on hold and shall result in the removal of your details from the files until you tell DDM you are once again happy to be matched.
8. For reasons of discretion, DDM does not normally pro-actively phone members to check how their membership is going. Consequently, it is my responsibility to contact DDM to inform them of any issue of concern affecting my membership.
9. It is my responsibility to inform the agency each time I require a further introduction. DDM consultants will subsequently arrange an introduction, providing I have made every endeavour to meet those members to whom I have already received an introduction.
10. As an Option C member I am entitled to 3 face-to-face progress reviews with a Senior DDM Consultant. DDM consultants will be made available to me providing I request their assistance when I telephone DDM to schedule a visit to DDM offices. I may make a matching guide list on my own at the start of my membership and may add to this at each of my progress reviews. (These shall be used as a guide for the Consultants doing the matching, as opposed to being a specific list of people that I shall meet.)
11. With Option C Membership, I am guaranteed 15 introductions (see clause 6) - providing I request them. My guaranteed introductions should be spread over my active membership time. DDM does not undertake to make more than one introduction on my behalf per month.
12. I am entitled to date portraits if I so wish. I may telephone the DDM office prior to making contact with a potential date, and a member of the team will tell me a little about the person.
13. Whilst I am not on hold and providing I have not requested extra confidential membership, copies of my hand-written Profile and photograph will be kept in the offices of DDM and made available for members to view. To maintain confidentiality my address and telephone number will not be displayed on these copies of my hand-written Profile. On occasion, whilst not on hold I may receive the hand-written Profiles and photos of all members who have requested that their details be sent to me speculatively. Receiving a member’s handwritten Profile and photograph is an additional way that I might meet another member but making contact with him or her is entirely my choice.
14. DDM will use every reasonable endeavour to ensure that members receive the service referred to in this contract but will accept no responsibility for the outcome of any meeting, nor guarantee that specific members who have agreed to phone will actually do so. No refund will be payable except where DDM has failed to offer the level of service indicated in this contract and unless active membership has been running for fifteen months (or more if it has been extended by DDM) and members have not prejudiced the ability of DDM to provide the service by changing the specification of the type of people they wish to meet, or in any other way or through not informing DDM that telephone or actual introductions have not been forthcoming. Any outstanding payment (cheque/debit card/credit card instalment or standing order) due to DDM must be honoured.
15. DDM reserves the right to head-hunt potential partners from outside the agency if appropriate. Head-hunted people may be retained on a passive, non-fee-paying basis.
16. It is recommended that all initial meetings take place in a public place and visits to members' homes should not take place until both parties feel entirely comfortable with this.
17. All reasonable steps are taken by DDM to safeguard confidentiality. However, membership is only granted on the understanding that profiles, photographs, names and telephone numbers can be released to potential contacts.
18. All information supplied to DDM is understood to be accurate but DDM cannot give any warranty as to its accuracy nor shall it be responsible for any inaccuracies.
19. In dealing with DDM I will have access to and will be entrusted with information in respect of DDM members all of which is confidential. I shall not now, or at any time in the future, divulge any of such confidential information to any person whatsoever.
20. I do not have a criminal record.
21. It is my responsibility to inform DDM in writing if I no longer wish my name to be included in the company records.
22. I have not acted on any representation, promise, warranty or guarantee whether expressed, implied, verbal or in writing, other than as contained in these conditions of membership and in the literature referred to herein which I have received and read. I understand that the signing by me of these conditions of membership shall constitute a Contract binding in Law between myself and DDM.
23. I agree to pay the current
registration fee and service charge for the level of membership stated
below entitling me to provision by DDM of the services indicated above on
the terms stated.
